Terms and Conditions
DEFINITIONS
The “Seller” is defined as the legal entity Flirt Inc (o/a Flirt Cupcakes). The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in the invoice.
GENERAL
These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Flirt Cupcakes you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted on this website from time to time.
PAYMENT AND DEPOSIT
We require a 50% deposit to confirm an order. The remaining 50% is due upon pick up. Deliveries need to be paid in full at the time of placing the order. All changes must be confirmed (changes to the previously agreed design, delivery address…etc may incur extra fees) 72 hours prior to the pick up/delivery date. All orders without a deposit are considered quotes and not confirmed orders. Deposits are fully refundable up until 14 days prior to the order date.
DELIVERY ORDERS
Deliveries placed online through our website require a minimum 24 hours notice.
DELIVERY TIMES
Deliveries are available Monday to Saturday between 12pm and 5pm. While we do our best to deliver within the selected time window, occasionally due to circumstances out of our control, we can not guarantee it. We do not offer refunds for deliveries delivered outside of the selected time window. If a delivery is time-sensitive (ie for a meeting) please us at 780-757-4899 prior to ordering and it's likely we can arrange something to make this happen!
RESDIENTIAL DELIVERY
For the safety of our staff and customers, we're currently doing contactless delivery only for all residential deliveries. Deliveries will be left on the doorstep and a text message will be sent to the recipient to notify them of the delivery (unless otherwise specified by the customer).
COMMERCIAL/BUSINESS DELIVERY
We follow all recommended protocols to safely deliver to businesses including proper sanitization and masks worn indoors at all times.
CONDO/APARTMENT DELIVERY
All deliveries to condo and apartment buildings require clear instructions on how the recipient should be contacted upon delivery. If the recipient is not home and requests the package be left in the lobby doorway, the recipient assumes all risks. If the courier is unable to reach the recipient the package will be returned to our store for the recipient to pick up at their convenience. Delivery may also be re-attempted the next business day after a new delivery fee has been paid.
PRICE QUOTATIONS
All price quotations, written or verbal, are subject to change based on alterations. Otherwise, quotes are honored for 30 days.
CANCELLATIONS, REFUNDS AND ALTERATIONSIf you have any queries or need to make any changes to an order please contact us immediately. We will assess your request for an alteration and let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations must be made 72 hours prior to the pick up/delivery date. Orders paid in full and cancelled with more than 2 weeks’ notice will receive a full refund of the total amount paid. Orders cancelled with less than 2 weeks may receive full credit, except in the case where an order is cancelled with less than 24 hours’ notice. No credit or refund will be offered. In the unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree on a suitable alternative. If you are not willing to accept our suggested alternative, then we will refund the full price to you.
CONSULTATIONS/TASTINGS
Consultations and in-store tastings are by appointment only and require a minimum 72 hours notice. To go taster packs require a minimum 24 hours notice. An appointment for a consultation and tasting must be agreed on with Flirt Cupcakes and the consultation or taster pack fee must be paid in full prior to the date before it can be confirmed.
DAMAGES
In the unlikely event that your delivery order arrives damaged, it is the customer’s responsibility to report the damage to us within 24 hours and send photographic evidence of the damage if you wish to claim a refund or replacement. The Seller accepts no liability for cupcakes or cakes once the customer has received the order in it’s original condition. We can offer suggestions on the best way to transport your order but the responsibility lies in the hands of the customer. Damages after this point are not Flirt Cupcakes responsibility. All Flirt Cupcakes baked goods are fragile and require care and attention when handling, storing, and displaying. We can offer suggestions on the best way to transport your goods but the responsibility lies in the hands of the receiver.
